FanGigs is an adult-industry-related platform. By accessing or using FanGigs, you agree to these Terms of Use. If you do not agree, do not use the platform.
1. Company Information
FanGigs is operated by Zincelo LLC, a Missouri limited liability company, doing business as FanGigs.
In these Terms, the words “FanGigs,” “we,” “us,” and “our” refer to Zincelo LLC d/b/a FanGigs.
These Terms apply to all visitors, registered users, talent, creators, producers, businesses, advertisers, contractors, and any other person or entity that accesses or uses FanGigs.
2. Acceptance of These Terms
By accessing, browsing, creating an account, posting a gig, applying to a gig, messaging another user, uploading content, or otherwise using FanGigs, you agree to be bound by these Terms and our applicable policies.
You are responsible for reviewing these Terms before using the platform. If you use FanGigs on behalf of a business or other entity, you represent that you have authority to bind that business or entity to these Terms.
3. Eligibility and Age Requirement
You must be at least 18 years old to access, create an account, post a gig, apply to a gig, communicate with users, or participate in any activity on FanGigs.
By using FanGigs, you represent and warrant that you are at least 18 years old, legally able to enter into these Terms, and legally permitted to participate in the activities you conduct through the platform.
FanGigs has zero tolerance for any content, activity, request, communication, or transaction involving minors, underage persons, non-consensual activity, exploitation, coercion, or trafficking.
4. Platform Purpose
FanGigs is an online platform designed to help adult content producers, creators, models, performers, camera operators, and related industry professionals discover casting calls, collaboration opportunities, production gigs, and related work opportunities.
FanGigs is a listing, discovery, communication, and networking platform. Unless we expressly state otherwise in writing, FanGigs is not an employer, talent agency, casting agency, union, payroll company, escrow service, payment guarantor, legal representative, tax advisor, financial advisor, or party to private agreements between users.
5. No Employment, Agency, Partnership, or Guarantee
Nothing on FanGigs creates an employment relationship, partnership, joint venture, agency relationship, franchise relationship, fiduciary relationship, or representative relationship between FanGigs and any user.
Users are independent parties. FanGigs does not hire, supervise, direct, control, or guarantee any user, producer, talent, creator, contractor, applicant, job poster, or opportunity.
FanGigs does not guarantee that any job post is legitimate, that any user is trustworthy, that any applicant will be hired, that any production will happen, that any payment will be made, or that any collaboration will meet your expectations.
6. User Accounts
- You are responsible for maintaining the security of your account.
- You may not share your login credentials or allow another person to use your account.
- You may not impersonate another person, create a fake profile, or misrepresent your identity, age, role, business, experience, availability, authority, credentials, or intentions.
- You agree that all information you provide must be accurate, current, complete, and not misleading.
7. User Responsibility and Legal Compliance
Users are solely responsible for complying with all laws, regulations, industry rules, platform rules, age-verification requirements, consent requirements, recordkeeping requirements, tax obligations, licensing requirements, immigration/work authorization requirements, workplace safety rules, and contractual obligations that apply to their activities.
Producers, creators, performers, models, camera operators, and other users are responsible for conducting their own due diligence before working together, including verifying identity, age, consent, boundaries, payment terms, location, legal compliance, and the legitimacy of any proposed work.
You agree not to use FanGigs to avoid or bypass any legal requirement, safety requirement, consent requirement, age-verification requirement, or recordkeeping requirement.
8. Job Posts, Applications, Messages, and User Content
Users are responsible for all job posts, applications, profile information, messages, images, links, descriptions, offers, rates, availability, and other content they submit or share through FanGigs.
You represent that you have the legal right to upload, post, submit, display, or share any content you provide and that your content does not violate another person’s rights or any law.
FanGigs may review, remove, restrict, hide, edit, or refuse any content at any time if we believe it violates these Terms, creates risk, is misleading, is unlawful, or may harm the platform or its users.
9. Prohibited Content and Conduct
You agree not to post, upload, request, promote, facilitate, or engage in content or conduct that:
- Is illegal, abusive, threatening, harassing, hateful, discriminatory, or exploitative.
- Involves minors, underage persons, or anyone who cannot legally consent.
- Involves non-consensual acts, coercion, trafficking, exploitation, blackmail, or abuse.
- Violates intellectual property, privacy, publicity, confidentiality, or contractual rights.
- Requests or promotes illegal prostitution, illegal escorting, illegal sexual services, or any unlawful transaction.
- Includes spam, scams, fraud, misleading information, fake job posts, or deceptive offers.
- Attempts to bypass platform safety rules, account restrictions, payment rules, or verification requirements.
- Promotes illegal services, illegal substances, weapons misuse, violence, stalking, doxxing, or unsafe activity.
- Uses bots, scraping, automated harvesting, reverse engineering, or unauthorized data collection.
- Otherwise violates these Terms, platform policies, or applicable law.
10. Communications, Meetings, and Off-Platform Activity
FanGigs may provide messaging or communication tools, but users are solely responsible for their communications and any decision to communicate, meet, work, collaborate, pay, travel, or transact with another user.
FanGigs is not responsible for what happens during off-platform communications, in-person meetings, productions, collaborations, travel, auditions, shoots, or private arrangements between users.
You should use caution, verify information independently, use written agreements, protect your safety, and comply with all applicable laws before participating in any opportunity.
11. Payments and Transactions
Unless FanGigs expressly provides a specific paid feature or payment service, users are responsible for negotiating, documenting, and fulfilling their own payment terms.
FanGigs is not responsible for enforcing private agreements, collecting unpaid amounts, guaranteeing payment, resolving payment disputes, refunding user-to-user payments, or guaranteeing the performance of any user.
If FanGigs later offers paid features, subscriptions, promoted listings, commissions, marketplace tools, or payment services, additional terms may apply.
12. Intellectual Property
FanGigs, including its branding, design, layout, software, text, graphics, logos, platform features, and user interface, is owned by Zincelo LLC or its licensors unless otherwise stated.
You may not copy, reproduce, distribute, modify, sell, scrape, reverse engineer, frame, mirror, or commercially exploit FanGigs content, code, or branding without written permission.
By submitting content to FanGigs, you grant FanGigs a limited, non-exclusive, worldwide license to host, store, display, process, transmit, and use that content as necessary to operate, improve, protect, and promote the platform, subject to applicable privacy settings and policies.
13. Reporting Violations
If you believe a user, post, message, profile, or activity violates these Terms or creates a safety concern, you may contact us at contact@fan-gigs.com.
FanGigs may investigate reports in its discretion, but we do not guarantee any specific outcome, response time, or enforcement action.
14. Suspension, Removal, and Termination
We may suspend, restrict, remove, hide, or terminate your account, posts, messages, listings, applications, profile, access, or use of FanGigs at any time if we believe you have violated these Terms, created risk for other users, provided false information, engaged in illegal or harmful conduct, or used the platform in a way that may expose FanGigs or Zincelo LLC to legal, financial, operational, or reputational risk.
We may also preserve or disclose information when we believe it is necessary to comply with law, enforce these Terms, respond to legal process, prevent fraud, protect safety, or protect the rights and property of FanGigs, Zincelo LLC, users, or others.
15. Disclaimers
FanGigs is provided on an “as is” and “as available” basis. We do not guarantee that the platform will be uninterrupted, error-free, secure, accurate, complete, available, profitable, or suitable for your needs.
We do not guarantee the accuracy of user profiles, job posts, applications, messages, availability, compensation, identity, qualifications, experience, consent, legality, or representations made by users.
FanGigs does not provide legal, tax, financial, employment, safety, immigration, compliance, medical, or professional advice. You are responsible for obtaining your own professional advice where needed.
16. Assumption of Risk
You understand that using an adult-industry-related platform may involve risks, including personal safety risks, privacy risks, business risks, reputational risks, financial risks, legal risks, and risks arising from interactions with other users.
You voluntarily assume all risks related to your use of FanGigs, your communications with users, your participation in gigs or productions, your decision to meet or work with another user, and any private agreement or transaction you enter into.
17. Limitation of Liability
To the fullest extent permitted by law, FanGigs, Zincelo LLC, and their owners, officers, contractors, service providers, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, punitive, exemplary, or lost-profit damages.
This limitation applies to any losses, disputes, injuries, claims, payments, chargebacks, missed opportunities, lost income, data loss, reputational harm, emotional distress, damages, or legal claims arising from or related to user interactions, job arrangements, communications, meetings, content, private agreements, platform use, inability to use the platform, or reliance on information provided through FanGigs.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to FanGigs or these Terms will not exceed the greater of the amount you paid directly to FanGigs in the three months before the claim arose or one hundred dollars ($100).
18. Release of Claims
To the fullest extent permitted by law, you release FanGigs, Zincelo LLC, and their owners, officers, contractors, service providers, agents, and affiliates from claims, demands, damages, losses, liabilities, and disputes arising out of or related to your interactions, communications, transactions, agreements, meetings, productions, collaborations, or disputes with other users.
You understand that FanGigs is not responsible for monitoring, controlling, guaranteeing, or supervising user-to-user conduct, agreements, or outcomes.
19. Indemnification
You agree to defend, indemnify, and hold harmless FanGigs, Zincelo LLC, and their owners, officers, contractors, service providers, agents, and affiliates from and against any claims, demands, damages, losses, liabilities, costs, expenses, and attorneys’ fees arising out of or related to:
- Your use or misuse of FanGigs.
- Your content, posts, messages, listings, applications, or profile information.
- Your violation of these Terms or applicable law.
- Your interaction, transaction, agreement, dispute, meeting, or collaboration with another user.
- Your violation of another person’s rights, including intellectual property, privacy, publicity, contractual, or safety rights.
20. Third-Party Services and Links
FanGigs may link to or integrate with third-party websites, tools, payment processors, hosting providers, analytics providers, social platforms, verification tools, or other services.
We are not responsible for third-party services, websites, content, policies, fees, errors, outages, conduct, or decisions. Your use of third-party services may be governed by their own terms and policies.
21. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles, unless applicable law requires otherwise.
You agree that any dispute not otherwise resolved between you and FanGigs or Zincelo LLC may be brought in the appropriate courts located in Missouri, unless applicable law requires another venue.
22. Changes to These Terms
We may update these Terms at any time. When we do, we may update the “Last updated” date above. Continued use of FanGigs after changes are posted means you accept the updated Terms.
If you do not agree to the updated Terms, you must stop using FanGigs.
